In a letter dated August 24, 2005, from Andrew James, AGFC Waterfowl Program Coordinator:
"I am writing in response to your letter received in my office on August 24, 2005. In your letter you describe your product known as the "Arkansas Kicker". AGFC code 12.26 was written to regulate only the use of "spinning or flapping blade devices that simulate wing movement". Since your decoy does not simulate the movement of wings, it is not in violation of code 12.26 and may be legally used in Arkansas for the purpose of waterfowl
