Is it Legal in my state

 
The Short Answer is YES!
 
States with special regulations are listed below along with the ruling and why the Wing Magic IS LEGAL! If your state is not listed then we are not aware of any regulations that would affect the use of a Wing Magic Decoy!

Arkansas
Arkansas Law outlaws anything that simulates spinning or flapping wings.  Thus, the Arkansas Kicker was born!  It does not simulate either.  Instead it creates realistic splashing coming out of the decoy.  Since the Arkansas Kicker does not simulate spinning or flapping wings, it is LEGAL in Arkansas.

California

Here is the law as it is written by the DFG:

It is unlawful to use electronic or mechanically operated spinning blade devices or spinning wing decoys when attempting to take waterfowl from the start of waterfowl season through November 30. For the purposes of this regulation, wind powered spinning blade devices and kites are not prohibited.

The Wing Magic is not a spinning wing decoy and therefore LEGAL in California!  The Wing Magic Decoy has wings that flap back and forth.


Minnesota

This is the law as it is written by the MDNR:

From the opening day of the duck season (which includes Youth Waterfowl Day) through Saturday October 7, a person may not use a motorized decoy or  other motorized device designed to attract migratory birds to take migratory waterfowl. On water bodies and lands fully contained within state wildlife management area boundaries, a person may not use motorized decoys or motorized devices designed to attract migratory birds at any time during the duck season. This restriction applies whether the motor is running or not. Devices without motors, such as wind-powered spinning-wing decoys, are not restricted under this law.

The Wing Magic does not use a motor and is therefore LEGAL in Minnesota!


Oregon

This is the law as it is written by the ODFW:

No person shall hunt game birds with the use of decoys powered by motor, battery, or other self powered methods. Quiver magnets are also illegal.  Decoys with parts that are moved solely by human actions (for example, via a cable or pull-string) or the wind are allowed.

Wing Magic does not use a motor or battery.  It does use a pull-string and therefore it is LEGAL in Oregon!


Pennsylvania

This is the law as it is written by the PGC:

The use of decoys powered or operated by batteries or any other source of electricity are unlawful for use in Pennsylvania.

Wing Magic does not use a motor, battery, or electronics.  Therefore it is LEGAL in Pennsylvania.


Washington

This is the law as it is written by the WDFW:

In August 2001, the Washington Fish and Wildlife Commission prohibited the use of battery-powered and other electronic decoys for hunting waterfowl. The rule (WAC 232-12-257) applies only to battery-powered and other electronic devices used as decoys. All devices that are powered by batteries (including, but not limited to "quiver/shaker magnets") or otherwise use electric current (including, but not limited to solar or AC power) are prohibited for use in attracting waterfowl in Washington. Other methods of creating motion in decoys are not prohibited (e.g., "jerk-cords", flags, kites, windsocks, and other wind-powered decoys).

Wing Magic Decoys do not have a motor or electronics and are therefore LEGAL!
